What the Service Agreement Covers

This agreement between you and JMI governs the use of the online JMI Web site subscription service. These services permit JMI subscribers to perform a number of functions through their individual account linked to the service through the use of a personal computer.

Accepting the Agreement

When you use any of the online JMI Web site services described in this Agreement you agree to the terms and conditions of the entire Agreement.

Relation to other Agreements

Your use of the Web site services may also be affected by the agreements between us and other linked accounts. When you link to another account, you do not change the agreements you already have with us for that account. You should review those agreements for any applicable fees and for any other restrictions which might impact your use of an account with JMI.

Online Service for Subscribers

To register online for JMI services you must provide the following:

• An internet access device with service through an internet service provider.
• An online ID and online password.
• A computer equipped with a modem and support browser.
• Word for Windows
• You may change your ID and Password.
• You may send us secure online mail messages and questions regarding your JMI subscription services.
  

Web Site Guarantee

JMI does NOT guarantee 100% site availability. At times Web site features may not be available due to subscriber personal computer malfunction, internet conditions, power company conditions, links under construction, system maintenance, upgrades, future features or other acts of God.

Levels of Service

Workstation Level
A subscriber may choose to register for a free 30 day account at no cost or obligation. Following that period, a subscriber must subscribe to receive further service.

JMI offers additional services and personal assistance including seminars, conferences, video conferences, products and specialized team consulting. Executive Pastor, Church Administrator, Church Staff Member and Church Lay Leader Management Team Training is also available.

Other Terms and Conditions

Monthly Service Charge

Regular payment is made monthly (EVERY 30 DAYS) automatically charged to your PayPal ? Account. Price is based on the level of service the subscriber chooses.

WORKSTATION LEVEL- $35.00

JMI will bill the subscriber's credit card not more than 5 days prior to the renewal date. If payment has not been received by the renewal date, the account will be suspended.

Additional JMI services including seminars, conferences, video conferences, products, consulting and training will be billed by segment. All unused minutes are cancelled at the end of the month. Additional minutes are posted to an account based on the service level at the beginning of a new month.When subscribing to services paid in advance (See "Profiles" and "Acount Information") JMI offers additional monthly minutes.

Other Charges

A $20 per hour research fee will be imposed upon difficult subscription accounts. If for any reason payment is not made within 5 days of the due date you must pay in addition to the payment a late charge of 15% of the amount past due (but at least $5.00) for each late payment. Each month the past due payment remains unpaid an additional late fee of the amount defined will be assessed. The subscriber will pay collection costs including reasonable attorneys' fees and in-house legal expenses. Such collection costs include, but are not limited to charges for collection letters and collection phone calls made, charges for collection-agencies, courts, sheriffs, witness travel expenses, etc. There will be a processing charge of $20.00 or whatever fee is allowable by law for any rejected credit card charge or any rejected automatic bank account debit.

Refunds

JMI reserves the right to apply service credit to subscription accounts on a case by case basis. No refunds are available.

Service Hours

Initiating Inquiries - Account Information

JMI offers a 365 days a year, 24 hours a day, subscriber "Contact Us" section on the website to receive questions or inquires except during times of system maintenance or upgrades.

Business Days

Our business days are Monday through Friday, excluding holidays.

Canceling of Service

A subscriber must give JMI 30 days notice of service cancellation. You may cancel your service at any time by notifying us of your intent to cancel in writing to JMI, 22683 SW 105th Avenue, Tualatin, OR, 97062, the JMI "Contact Us" link, or calling 888.josiah3. Service remains in effect until it is terminated by you or JMI. Subscriber is responsible for unsubscribing through their PayPal? account. Instruction on how to do this are here . JMI may terminate your participation for any reason, at any time. We will try to notify you in advance, but we are not obligated to do so.

Changes to Agreement

We may change this Agreement at anytime. For example, we may add, DELETE or amend terms or services. We will notify you of such changes by mail or electronic mail. If you maintain your online JMI Website service after the effective date of a change, you indicate your agreement with the change

Reporting Unauthorized Service Use

Disclosure of Account Information

We will disclose information to third parties about your account:
When it is necessary for completing subscriber requests, or to investigate or resolve a problem.
To verify the existence and condition of your account for a third party, such as a credit bureau or merchant.
To comply with a government agency.
If you give us permission.
At our discretion, to our affiliates.
On a closed account, if we reasonably believe you have mishandled it.

In Case of Errors or Questions

If you think an error has occurred
You need more information.
An unauthorized person has discovered your online JMI password.
We MUST hear FROM you no later than 60 days FROM the day the error has taken place. If you tell us verbally, we may require you to send us your complaint or question in writing or via e-mail within 10 business days.
When you contact us, please provide the following information:
Your name and account number.
A description of the problem.
Please EXPLAIN as clearly as you can why you believe there is an error or why you need more information. We will tell you the results of our investigation within 10 business days after we hear FROM you, and will promptly correct any error we have made. If we need more time, however, we may take up to 45 days to investigate your complaint or question.
If we think there was no error, we will send you a written explanation within 3 business days after we complete our investigation through e-mail or direct mail. You may request copies of the documents that we used in our investigation.

Protecting Your Password

You may agree that we may send notices and other communications, including password confirmations, to the current address (both direct and e-mail) shown in our records, whether or not that address includes a destination for delivery to the attention of any particular individual. You further agree that JMI will not be responsible or liable to you in any way if information is intercepted by an unauthorized person, either in transit, or at your place of business. You agree to keep your password secure and strictly confidential. Immediately notify us and SELECT a new password if you believe your password may have become known to an unauthorized person. We may suspend or cancel your password and service even without receiving such notice FROM you, if we suspect your password is being used in an unauthorized or fraudulent manner.

Acknowledgement of Reasonable Security Procedures

By using the online JMI Web site, you acknowledge and agree that this Agreement sets forth security procedures for it's use. You agree to be bound by instructions, whether authorized or unauthorized, which we implement in compliance with these procedures, unless you have given us prior notice of possible unauthorized use as described above (and we had a reasonable opportunity to act on such notice).

Limitation of JMI Liability

If JMI fails or delays in providing reasonable service based upon the JMI Service Agreement, we may credit the account of the subscriber. Following a full investigation a decision may be rendered on a case by case basis, but in no event will JMI be liable to any party. UNLESS OTHERWISE REQUIRED BY LAW, IN NO EVENT WILL JMI BE LIABLE TO YOU FOR SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES INCLUDING, WITHOUT LIMITATION, LOST SERVICE OR ATTORNEY'S FEES, EVEN IF WE ARE ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES.

Copyright and Intellectual Property Restrictions

Josiah Ministries, Inc. (JMI) claims and retains exclusive copyright and intellectual property ownership rights for all consultation materials, "Article Database" content and any other materials provided as a part of subscription service to our customers and clients. By providing access and limited use of the content on this website to our customers, JMI is granting a limited license to use the content only for the specific church or ministry subscribed as a customer. No rights of ownership, reprint, electronic transmission, electronic duplication, printed re-distribution or sale to third parties is conveyed to our customers. JMI reserves the right to terminate a customer account and demand surrender and/or proof of destruction of all materials made available to a customer in the event that JMI believes the customer has infringed upon these rights retained by JMI.

The JMI website contains features which allow subscribers to upload their personal files to JMI. Subscriber agrees that any material uploaded to JMI automatically confers to JMI the unrestricted right to use, reproduce, edit or distribute the uploaded material in any way deemed appropriate by JMI, with or without credit to the subscriber, without fee or royalty obligations to the subscriber, unless the subscriber specifically instructs, reserves or limits JMI to the contrary at the time of uploading each file. Subscribers are not permitted to upLOAD to JMI any copyrighted works of third parties, since distribution to JMI of copyrighted works of third parties may be an infringement of the intellectual rights of the original author.
